Coverage under this Agreement is contingent upon the following:

2. Coverage Start Date

Coverage under this Agreement begins 30 days after receipt of the full Agreement Fee. However, if You provide documentation of prior coverage through another carrier with no lapse in coverage, Your coverage will begin immediately upon receipt of the Agreement Fee.

Services rendered without prior approval from Prestige Home Guard will not be eligible for reimbursement. All service requests must be formally authorized before any repair or replacement work is initiated.

For each service request submitted, You will be required to pay a Service Fee as specified in Your Coverage Details. This fee must be paid to the assigned Service Provider at the time of service.

  • Non-Payment Consequences:
Failure to pay the Service Fee will result in the suspension of Your Agreement. Service will not resume until all outstanding fees have been paid in full.
5. Guarantee on Completed Work

If a covered repair performed under this Agreement fails within 30 days, Prestige Home Guard will address and correct the failure at no additional cost to You, including waiving the Service Fee for the follow-up request.

We reserve the right to seek a second opinion from another Service Provider at our expense to validate any claim.

I. RESOLUTION OF DISPUTES – MANDATORY ARBITRATION

(Refer to Section L for state-specific details)

Mediation:
In the event of any dispute or disagreement arising out of or related to this Agreement, you are required to submit a written claim to us and allow us a period of 30 calendar days to respond to your claim.

Mandatory Arbitration:
Any claim, dispute, or controversy—whether rooted in contract, tort, statute, or other legal theory—arising out of or relating to this Agreement or the relationships between the parties shall be resolved exclusively through binding arbitration. This arbitration will be conducted by a single arbitrator under the rules of the American Arbitration Association (AAA), specifically its Commercial or Consumer Arbitration Rules, as applicable, effective at the time the claim is filed.

  • AAA Rules and forms are accessible at adr.org or by calling 1-800-778-7879.
  • The arbitrator’s decision will be final, binding, and non-appealable.
  • Judgment on the arbitration award may be entered in and enforced by any court with jurisdiction.

This arbitration clause is pursuant to a transaction involving interstate commerce and is governed by the Federal Arbitration Act (9 U.S.C. § 1, et seq.).

Neither party may pursue claims in court except to enforce the arbitration clause or an arbitrator’s award. Any such court proceeding may be brought only in a Federal District Court, or if that court lacks jurisdiction, in a state court with appropriate jurisdiction.

The arbitrator has the sole authority to decide disputes regarding the interpretation, applicability, enforceability, or formation of this Agreement, including claims of unconscionability, voidness, or voidability. However, this authority does not extend to matters covered under the Class Action Waiver provision below.

Class Action Waiver:
All claims, disputes, or controversies arising from or related to this Agreement must be pursued individually and not as part of any class, collective, representative, or multiple-party proceeding.

  • You waive your right to participate in any class action or similar proceeding in any forum.
  • The arbitrator has no authority to combine or aggregate claims, conduct class proceedings, or grant awards to anyone who is not a direct party to the arbitration.

If any part of this Class Action Waiver is deemed unenforceable, void, or unconscionable, such determination shall only be made by a court of competent jurisdiction, not an arbitrator.

Acknowledgment of Arbitration and Class Action Waiver:
By entering into this Agreement, the parties explicitly waive their rights to litigate disputes in court, to have claims decided by a judge or jury, and to participate in a class or representative action.

Multiple Agreements:
If you hold more than one Agreement with us, separate arbitration proceedings must be filed for each Agreement. No single arbitration can cover multiple Agreements.

Choice of Law and Venue:
All matters regarding the construction, validity, interpretation, and enforcement of this Agreement shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict-of-law rules. Any legal proceedings arising from this Agreement must be held in the State of New Jersey, unless prohibited by applicable law or otherwise mutually agreed upon by the parties.
